1Introduction

Welcome to HaikuVibe ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of the HaikuVibe mobile application (the "App"), operated by developershutt.

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2Eligibility

By creating an account or using the App, you represent that you are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

3User Accounts

To access certain features, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Choose a username 3–15 characters long, containing only lowercase letters, numbers, periods (.), and underscores (_). Usernames must be unique.
• Maintain the security of your password and accept all risks of unauthorized access.
• Notify us immediately if you discover or suspect any security breach related to the App.

4User-Generated Content

The App allows you to create, post, store, and share content, including haikus, comments, and images ("User Content").

4.1 Ownership and License

• Ownership: you retain ownership of any User Content you post.
• License: by posting, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, translate, and display such content in connection with operating and promoting the App.

4.2 Prohibited Content

You agree not to post content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
• Promotes hatred, violence, or discrimination based on race, ethnicity, religion, gender, or disability.
• Contains sexually explicit material or pornography.
• Infringes any patent, trademark, trade secret, copyright, or other proprietary right.
• Contains spam, unauthorized advertising, or promotional materials.

4.3 Content Moderation & Enforcement

• Review: we reserve the right to review, screen, and monitor User Content.
• Removal: we may remove any User Content at any time, without notice, if we believe it violates these Terms.
• Reporting: users can report spam, offensive content, harassment, inappropriate content, copyright infringement, or other violations directly in the App.
• Investigation: we investigate reports promptly and take appropriate action.
• Enforcement: depending on severity — warnings, soft-delete, temporary suspension, or permanent termination.
• Soft-Delete: removed content is hidden from public view, retained for admin review, and can be restored if removed in error.
• Appeals: contact [email protected] to appeal a removal or suspension.

5Administrator Roles & Moderation

5.1 Administrator Access Levels

• Super Admin: full access to all administrative functions, including content moderation, user management, and granting/revoking admin privileges.
• Moderator: can review and moderate content, manage reports, and take enforcement actions, but cannot manage other administrators.
• Viewer: read-only access to reports and moderation logs for oversight.

5.2 Administrative Actions & Audit Trail

• All administrative actions (content removal, report dismissals, role changes) are logged in an immutable audit trail.
• Administrators must act in accordance with these Terms and our internal moderation guidelines.
• Administrative access is granted only to authorized, trained personnel.

5.3 User Rights Regarding Moderation

• You have the right to know why your content was removed or why enforcement action was taken.
• You can request clarification by contacting [email protected].
• You may appeal moderation decisions you believe were made in error.

6Acceptable Use Policy

You agree not to use the App to:

• Harass, abuse, or harm another person.
• Impersonate any person or entity.
• Interfere with or disrupt the App or its servers.
• Attempt to reverse engineer or compromise the security of the App.
• Violate any applicable local, state, national, or international law.

7Intellectual Property Rights

The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of developershutt and its licensors. The App is protected by copyright, trademark, and other laws.

8Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, at our sole discretion, for any reason — including breach of these Terms.

8.1 Effect of Termination

• Upon termination, your right to use the App ceases immediately.
• Your User Content may be soft-deleted or permanently deleted at our discretion.
• We may retain certain data as required for legal compliance, dispute resolution, or audit purposes.

9Disclaimers & Limitation of Liability

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the operation or availability of the App.

In no event shall developershutt be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, use, goodwill, or other intangible losses — resulting from your access to or use of, or inability to access or use, the App.

10Governing Law

These Terms are governed and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

11Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect.
